Malice Green died on November 5, 1992. By December 2nd Officers Budzyn and Nevers, Sergeant Freddie Douglas and Officer Robert Lessnau were all dismissed from the police department, and Officers Gunther, Goteleare and Kijek were suspended without pay. Below is the text of Larry Nevers discharge sheet indicating that he was being dismissed for committing second degree murder. Remember that at this time Nevers had not even been bound over for trial, let alone tried and convicted. Remember also that all these officers had been denied, for the first time in the history of the Detroit Police Department, a Police Board of Review. Their side of the story was never heard, nor was the Board of Review allowed to question any of the other witnesses.

Specification 1: that he POLICE OFFICER LARRY NEVERS, Badge 2034, of the Third Precinct, did, while on duty on November 5, 1992, at about 10:30 a.m., in the area of Warren and 23rd, cause the death of Mr. Malice Green by striking him with a flashlight, intending to do him great bodily harm or intending to create a very high risk of death or great bodily harm knowing that was the probable result of the mistreatment, thereby committing second degree murder, which tends to bring the department into disrepute and reflect discredit upon the individual as an officer; THIS BEING IN VIOLATION OF GENERAL ORDER 72-17, SECTION K, SUBSECTION 65, AND MCLA 750.317.
